2. Your rights as an interested party


Right of access (art. 15, par. 1, GDPR)

 

You have the right to be informed about whether IT work SCA is processing personal data concerning you and, if so, to access it and to obtain information about the categories of personal data processed, the purposes of the processing, the recipients or categories of recipients of the same, the expected conservation period or the criteria to determine said period, as well as to obtain information on the exercise of their rights. If your personal data is not collected directly from you, you also have the right to be informed of the origin of the data.

 

Right of rectification (art. 16 GDPR)

 

You have the right for IT work SCA to rectify and/or complete your personal data, in the event that the data processed is inaccurate or incomplete.

 

Right of erasure (art. 17 GDPR)

 

You have the right to request that IT work SCA delete your personal data. The data will be deleted if requested, except in those cases in which said deletion is not appropriate because the processing of the data continues to be necessary for any of the purposes for which they were provided or when the legally provided circumstances occur, for example if there is still an active contract or amounts pending payment.

It must be taken into account that the data cannot be deleted in cases in which IT work SCA is subject to legal retention periods or when there are conflicting interests that prevent it. In these cases, however, a block may be made that prevents processing for other purposes.

 

Right to limitation of treatment (art 18 GDPR)

 

In the following cases you can contact us to request a limitation of the processing of your personal data:

 

You have contested the accuracy of the data and want us to stop processing it in the meantime, pending final verification.

The treatment is illegal and you oppose its deletion, requesting instead the limitation of the treatment.

IT work SCA no longer needs the data for the purposes of the treatment, but you still need it for the formulation, exercise or defense of claims.

When you have opposed the data processing, proceeding to the limitation of the treatment while it is verified if the legitimate reasons for the treatment prevail over those of the interested party.

In the event that the limitation of the treatment proceeds, we make sure that the personal data cannot be processed or modified by us except for its conservation or in those cases in which the interested party gave their consent. If processing has been restricted in accordance with the above requirements, IT work SCA will inform you before the restriction is lifted.

 

Right to data portability (art. 20 GDPR)

 

You have the right to receive the personal data that concerns you exclusively and that you have provided us in a structured, commonly used and machine-readable format and, where appropriate, to transmit it to third parties.

 

Right of opposition (art. 21 GDPR)

 

You have the right to object at any time to the processing of personal data concerning you that are subject to processing based on the "legitimate interest of the data subject" (art. 6, par. 1, letter f, GDPR), including profiling .

 

In the event that your right of opposition applies, from IT work SCA we will stop processing your personal data, unless we prove the existence of compelling legitimate reasons for the treatment that prevail over your interests, rights and freedoms, or that the treatment serves for the formulation, exercise or defense of claims.

 

You can object at any time to the processing of data when it is for direct marketing purposes without having to indicate the reasons. If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for said purpose.

 

To exercise your right of opposition, you must send us your opposition so that IT work SCA can manage it as data controller. In some cases, you can do it directly online (for example: in the case of cookies) or through the IT work SCA client area (for example: in regards to receiving commercial information). You can also send an email protecciondedatos@itwork.digital to exercise your rights related to the protection of personal data (for example: your opposition).

 

Right to withdraw consent (art. 7, par. 3, GDPR)

 

You have the right to withdraw a consent that you have already given previously (for example: consent to receive commercial information) with effect for the future.

If you are already a customer, you can also carry out your withdrawal of consent from the customer area.

 

You can exercise the withdrawal of consent in relation to the processing of data through cookies at any time.

Right to file a claim with a control authority (art. 77 GDPR)

 

Likewise, you have the right to file a claim with the competent data protection control authority at any time.
